As a result of the reforms carried out in our country, a new institution - the Judicial-Legal Council, which is a self-governing body of the judiciary, was established and started functioning in February 2005. The 15-member Council was composed of mainly judges (9 members), and at the same time, representatives of other government branches were included in its composition.
Arrangement of preliminary and continuous training, assessment, changing of workplaces, promotion, imposition of disciplinary liability of the judges, as well as other issues related to their professional activities were attributed to the authority of the Council.
Procedure of disciplinary liability of the Judges was revised and while putting special attention on independence of the judiciary, it was established that the decision on imposition of disciplinary liability on judges shall only be adopted by the judge members of the Council.
After the changes made to the Law of the Republic of Azerbaijan "On the Judicial-Legal Council" in 2023, the Judicial-Legal Council has 9 judges (3 judges from each court instance) and 1 member as a representative of the legal community through open voting by the Conference of Judges, where all the courts of the Republic of Azerbaijan are represented. with, is elected by a simple majority of its participants. The term of office of the Council’s members is five years.
After the changes made to the Law of the Republic of Azerbaijan "On the Judicial-Legal Council" in 2023, 9 judges (3 judges from each court instance) and 1 member as a representative of the legal community as members of the Judicial-Legal Council shall be elected through open voting and by simple majority of its participants on the Conference of Judges, where all the courts of the Republic of Azerbaijan are represented. The term of office of the Council’s members is five years.
In addition to the members elected by the Conference of Judges, other members of the Judicial-Legal Council are a judge appointed by the Constitutional Court of the Republic of Azerbaijan, a representative appointed by the Milli Majlis (Parliament), a representative appointed by the Ministry of Justice, a lawyer appointed by the Bar Association, a jurist scholar appointed by the National Academy of Sciences.
The chairman of the Judicial-Legal Council is elected by a simple majority of the members of the Council from among the judge members of the Council.
The basis of the activities of the Judicial-Legal Council are the Constitution of the Republic of Azerbaijan, international agreements of which the Republic of Azerbaijan is a party, the laws of the Republic of Azerbaijan "On the Judicial-Legal Council", "On Courts and Judges" and other normative legal acts of the Republic of Azerbaijan.
The Judicial-Legal Council is an independent body that operates permanently and is independent of legislative, executive and judicial authorities, local executive authorities, as well as legal entities and individuals in organizational, financial, and any other respects. The Council operates in mutual cooperation with legislative, executive and judicial authorities, Bar Association of the Republic of Azerbaijan and scientific organizations.
